Colleges can be liable for student-on-student incidents of Sexual Harassment.

Student-on-student Sexual Assault is Sexual Harassment.

Colleges will be Liable when:

• Harassment is so severe, pervasive, and objectively offensive that it deprives the victim of access to educational opportunities.
  

• The college had control over the context within which the harassment arose.
  

• The college had control over the harasser.
  

• The college had "actual knowledge" of an did not appropriately respond to the complaint(s) of harassment.
  

• "Deliberate indifference" must be proven.
